Release & Waiver of Liability

1. I fully understand and acknowledge that my participation in such activities and/or use of a bounce house and/or equipment may result in my injury or illness including but not limited to bodily injury, disease strains, fractures, partial and/or total paralysis, eye injury, heat stroke, heart attack, death or other ailments that could cause serious disability.

2. I fully understand and acknowledge, for myself, my heirs and/or assigns, that by participating in this bounce house and/or equipment, I am stating that I do not have any physical and/or mental condition, which would affect my ability to participate in this bounce house and/or equipment, including but not limited to the following: back problems, heart conditions, pregnancy, epilepsy, motion sickness.

3. I knowingly understand this bounce house and/or equipment, and any others provided, can be physically intense and usually results in the participant falling.

4. I understand the rules of play and will comply with all rules and regulations. If I observe any unusual or unnecessary hazard during my participation, I will stop the hazard immediately.

5. Lessee acknowledges and represents that it has adequate homeowner’s insurance, tenant insurance, or other liability insurance to cover any bodily injury or property damage which might occur to itself, its guests, or its invitees from the use of the unit being rented or else lessee agrees to bear the cost of defense and liability of any such injury or damage to itself.

6. I, for myself and on behalf of my heirs, assigns, personal representatives and next of kin, hereby release and hold harmless from liability Jounce House, LLC. and employees, suppliers, vendors and contractors of Jounce House, LLC. Renter’s hosting organization(s), their officers, officials, agents and/or employees with respect to any and all injury, disability, death or loss or damage to person or property, whether caused by the negligence of Jounce House, LLC., its officers, officials, agents and/or employees and/or any of its affiliates identified herein or otherwise.

I understand and agree that this Release & Waiver of Liability covers each and every bounce house and/or equipment, in which I participate hereafter. I have read the forgoing Release & Waiver of Liability and my acceptance of the terms and conditions during the booking process expressly acknowledges that I fully understand and agree to the terms contained in the forgoing Release
& Waiver of Liability and I understand that I have given up substantial rights by signing this document. As such, I hereby sign this Release & Waiver of Liability freely and voluntarily and without any inducement or duress.

Bounce House General Rules

1. All participants must remove shoes, jewelry, badges and eyeglasses before entering our bounce houses.

2. All sharp objects need to be kept away from and out of our bounce houses, for obvious reasons. If you attach adornments to the bounce house and need assistance removing them properly, just let us know during pick up. We are happy to assist. Any damage caused by sharp objects will incur charges, up to the cost of a new bounce house, and will be charged to the card on file.

3. Paint and glitter of any kind is not permitted in or around our bounce houses. Our policy includes face paint, confetti, glitter, silly string, gender reveal powder and coloring instruments of all kinds. These items can cause permanent staining. Additional cleaning requirements and damages caused by these items will incur charges, up to the cost of a new bounce house, and will be charged to the card on file.

4. All food and drinks are strictly prohibited from entering our bounce houses. This policy includes gum and candy. We strictly enforce this to ensure your guest's safety, your safety and to ensure the longevity of our bounce houses. Additional cleaning requirements caused by food, especially gum, will incur a $350 cleaning fee, charged to your card on file.

5. We love all fur babies, but they are strictly prohibited from entering our bounce houses. Their nails can cause irreparable damage and pet "accidents" are not covered under our regular cleaning costs. Additional cleaning requirements and damage caused by pets will incur charges, up to the cost of a new bounce house, and will be charged to the card on file.

6. Piñata’s are strictly forbidden from being hung and/or broken open in our bounce houses. There is a high risk of severe injury. We strictly enforce this to ensure your guest's safety, your safety and to ensure the longevity of our bounce houses.

7. Smoking of any kind is not to be in, on or around any of our bounce houses. Smoking instruments can cause permanent staining and/or damage to our bounce houses. Additional cleaning requirements and damages caused by these items will incur charges, up to the cost of a new bounce house, and will be charged to the card on file.

8. Keep heating units and open flames away from our bounce houses at all times, the material will burn or melt. If the bounce house begins to lose air, make your way to the exit immediately. Damage caused by heat and/or open flames to our bounce houses will incur charges, up to the cost of a new bounce house, and will be charged to the card on file.

9. Each rental includes a full cleaning after each use. Should you return our bounce house with an excessive mess, your card on file will be charged a minimal $350 fee for additional cleaning services. Any damage to our bounce houses will incur charges, up to the cost of a new bounce house and will be charged to the card on file.

I have read the above Bounce House General Rules and fully understand that my acceptance of the terms and conditions during the booking process expressly acknowledges that I fully agree to all terms contained in the Bounce House General Rules. I am fully responsible for the bounce house and any equipment left in my care. I will pay for any loss or damage that may occur.

Bounce House Safety Rules

1. To avoid neck and back injuries please do not wrestle, flip, collide or fight in our bounce houses.

2. Do not bounce against the sides, near the doorway or on the step(s) of our bounce houses.

3. Individuals with head, back, neck or any muscular-skeletal injuries or disabilities, pregnant women, children under 3 years of age, and others who may be susceptible to injury from falls bumps or bouncing are not permitted in the unit at any time.

4. Do not allow older children to jump with younger children.

5. Do not hang from any part of our bounce houses. Damages caused by hanging on our bounce houses will incur charges, up to the cost of a new bounce house, and will be charged to the card on file.

6. Keep children away from the blower unit to prevent electric shock and serious injury.

7. Our bounce houses are not to be moved during the duration of the rental period. Damages caused by moving our bounce houses will incur charges, up to the cost of a new bounce house, and will be charged to the card on file.

8. Children’s safety depends on you. Your supervision is required. As the Lessee of the bounce house, the safety of all those who use the bounce house or parts thereof is your responsibility.

I am fully responsible for the bounce house and any equipment left in my care. I will pay for any loss or damage that may occur.

Bounce House Weather Rules

1. If inclement weather arrives on your event date, please let us know by 8:00 AM if you would like to re-schedule or alter the set-up location. We can easily set up indoors. If we are not notified by 8:00 AM, the reservation will be set up as scheduled. Once set up is complete, there are no refunds or
re-schedules.

2. Our bounce houses must be secured to the ground at all times, via stakes or sandbags, to prevent tipping or injury.

3. In the event that wind speeds reach 15+ MPH, you are to unplug the bounce house to prevent injury to jumpers or damage to the bounce house.

4. Bounce houses can flip over in high winds. If high winds exist, everyone must exit the bounce house immediately and turn off the blower.

5. Do not operate the bounce house when raining or if the ground is wet. The risk of serious injury due to slipping hazards and electric shock from the blower are possible.

6. We reserve the right to cancel any reservations due to severe or
imminent deterioration of weather conditions.

I am fully responsible for the bounce house and any equipment left in my care. I will pay for any loss or damage that may occur.

Policies & Expectations

General Policies

1. All Jounce House rental equipment is delivered in good condition, and it is expected that it will be returned in the same condition. Damage to our bounce houses will incur charges, up to the cost of a new bounce house, and will be charged to the card on file.

2. The customer assumes all responsibility for injuries to persons or damage to property and agrees to release and hold Jounce House, LLC. harmless for any and all claims, of whatsoever nature, arising out of use of the rental equipment while in his or her custody. In the event that the release and hold harmless as contained herein is held unenforceable for any reason, the customer hereby agrees to a limit on any damages claimed by the customer to the total paid to Jounce House, LLC. for the rental.

3. Customer agrees to Jounce House, LLC's right to enter premises of customer at any time to repossess the said equipment.

4. Customer agrees not to loan, sublet, or otherwise depose of equipment or use it at any other location.

5. Customer agrees to pay in full the replacement cost, including labor, for all damages to rental equipment.

6. If the bounce house and/or other equipment left with the customer is lost, stolen, or damaged beyond repair, the renter agrees to pay the entire cost to replace the bounce house and/or equipment.

7. There are no warranties of merchantability or fitness either expressed or implied.

8. The person/s or organization renting this equipment from Jounce House, LLC. will be held responsible and liable for any and all damage or injury occurring for any reason whatsoever.

Set Up Policy

All bounce houses must be set up in a clean area, within 100 feet of an outlet and with 3 feet of clearance on all sides. We can set up on grass, turf, asphalt, concrete, pavers, or inside a venue or home. We will not, under any circumstances, set up on rocks, gravel, or dirt. Sticks, rocks, animal waste etc., that are in the area where you would like us to set up, are to be cleaned up and removed before our arrival.

Cancellation Policy

In the event that you need to cancel your reservation, please let us know, at least 1 week in advance, for a full refund of your payment. If you do not, all payments made will be forfeited.

Right to Cancel Policy

In the event that we determine a situation is dangerous and/or uncomfortable for our employees or not ideal for business success, we reserve the right to cancel your reservation immediately. Our employees' well-being and business ethics take precedence over business transactions.

Payment Policy

All reservations are to be paid for in full, a week prior to your event. We do not carry cash or card readers. In the event that you do not pay the remainder of your balance, by the due date, your deposit will be forfeited, and your reservation will be canceled.

Party Hard Fee

Each rental includes a full cleaning after each use. Should you return our bounce house with an excessive mess, your card on file will be charged a minimal $350 fee for additional cleaning services. Any damage to our bounce house will incur charges, up to the cost of a new bounce house and will be
charged to the card on file.

Charge-back Policy

All fraud, including credit card fraud, will not be accepted by Jounce House, LLC. and as such will be fully investigated and pursued under the law to its fullest extent. Any losses resulting in Jounce House, LLC's behalf will be fully pursued in a civil lawsuit to claim back any losses incurred, covering all business, legal fees, research costs, human resources, and loss of income.
